Rights of Artwork

By Default, Commissioned works are for VTuber Streaming Only unless otherwise defined as commercial use for advertisement(1), streaming(2), or reproduction and sales purposes(3).

Artist retains the rights over the final artwork. Completed works may be used in a personal portfolio, artbook, social media (with proper credit to commissioner), or other unless NDA is contractually signed or requested.

Commissioner agrees to use the illustration as agreed upon in the terms and post credit to the artist when publishing to social media or print media.

Clients cannot directly alter the artwork or ask a third party to modify the artwork. If a client is to get additional art or models commission with regard to the character, the likeness of the model must be drastically different from the original.

Payment

Payment can be with Paypal, Venmo, or Bank Transfer and will be billed in USD with taxes and fees applicable.

Payment may be received in full or installments permissible in larger transactions. Individual fees per transaction may be charged.

Payment is refundable in circumstances where the work has not yet been started. Refunds will be processed based on the percentage of work completed at the time of the request as well as a 10% service fee for the intake of the project (to account for the file prep, discussion, and or any meetings or conversations and time slot given to start the commission.

Content and Subject Matter

Clients should have a general idea of what they want before initiating contact with the artist. If the client is unsure about a design or details, they may request “Character Design Commission” to flesh out details regarding the main idea of an illustration.

Reference pictures and detailed description should be provided by the client when appropriate. NSFW art should be marked appropriately. Supplemental references may be requested if the artist finds the reference board or accessory details unclear.

Timeline

We can only take commissions one at a time to ensure quality work delivery and non-rush deadlines. However if you would like to request a rush timeline, we may be able to navigate the existing schedule with a 30% rush fee on the total project.

Typical timeline for an Illustration Commission

Depending on the complexity and my current schedule. The whole process would take around
4-16 weeks.

Typical timeline for a VTuber Commission

1. Design Phase

a) Client provides either verbal or visual descriptions of character requested

b) Artist presents sketch to client

c) 2 Revision phases (with a maximum of 3 changes allowed)

d) Revision sketches are presented until the client is satisfied with the rough work in progress

2. Model Illustration Phase

a) Artist will request the client to get into contact with the rigger for any specific cutting requests

b) Expression and Expressive Arms and Hand requests will be received at this time and given a quote based on how complex the additional props and emotes are.

c) Illustration WIPs will be provided at intervals, maximum 3 updates

d) 2 Minor Revisions accepted, however if anything drastic needs to be edited(5) extra fees may be billed at an hourly rate

e) Final is presented to the client for approval

f) Artist will work on Expressions and show to client for approval

g) Preliminary Cutting will be done to a 20 degree rotation default if no instructions are given for cutting

3. Rigging Cutting Phase

a) Client sends Rigger the complete PSD

b) Rigger provides a document highlighting the necessary changes. **Would prefer if the rigger could screenshot the model and draw in specific model shapes if necessary to extend the art to a specific location.

c) Artist will make revisions on the final PSD (FileNameFinalRiggerID.psd) and send back for ok.

d) Any additional revisions can be requested at [email protected]

4. Add-On Illustrations Phase

a) Request for Character Sheet

a) Request for additional Expressions

Each of these 4 Illustration Phases are billed separately. I.e. If you already have a full character sheet, you will likely just need the model and cutting done for your specific use-case scenario.

Communication

Commissioner and Artist will communicate through email primarily and Discord as a secondary means of communication. Please do not send social media requests of DMs if possible as we do not check the inboxes very often. Tweeting @ the artist will get a one time warning. File transfer will be facilitated through Google Drive or Wetransfer to share updates or documents.

MISC.

Not all VTubers drawn will include a base body for future outfits. Please request this if you may feel it will be a possibility in the future.

Waitlist is available and can subscribe to a mailing list for when commissions open up. Commissions are not always first come first serve and will be evaluated based on criteria set by the artist and what they can accomplish during the specific time frame.

We reserve the right to refuse commissions that do not fit with our target style output or for any reason conflicts with our artistic values(4).

Any extraneous events such as injury, family emergency, or other health related mishaps will be communicated to the client in private if the work cannot otherwise be completed in an expected timeline.

Clients who behave unprofessionally may be canceled and refunded at any time for rude, demanding, inappropriate or excessive bad behavior. Clients will be refunded and likely not invited back for further commissions.

Payment and verbal or text agreement constitutes agreeing with these terms of service. Clients will be provided with this document before any work begins and will be held responsible for these terms.

Footnotes

(1) Limited reproduction rights on physical or digital banners or social media posts with the purpose to promote or advertise. Physical flyers and banners may be reprinted for the sole purpose of promotion. Usage limited.

(2) VTuber illustrations or assets related to streaming or promotion of a VTuber identity on social media. Specific request need to be made for physical reproduction of said assets

(3) Physical printing of merchandise for the use of sale-for-profit entities. Restrictions on usage dates and quantity limitations will be enforced.

(4) Some examples of commissions that may be refused include extremely realistic style requests, explicit NSFW content (I do not do those commissions at this time), or illustrations that copy or reference other designers or illustrators too closely.

(5) Minor revisions constitute edits that do not drastically change the silhouette of the hair, clothing, or body. Major color changes can be considered on a case-by-case basis, however gradient effects typically will create a larger workload than simple Hue Saturation Value changes.
